Welcome to the H&H Management Inc. website. These Terms of Service ("Terms") explain the rules for using our website and online services. By using our site, you agree to these Terms. If you don't agree, please don't use the site.
1.Who We Are
H&H Management Inc. ("H&H," "we," "us," or "our") is a property management company operating in Arizona, located at 12100 N Dysart Road, Surprise AZ, 85379. We help property owners manage their rental properties and help tenants find, apply for, and live in rental homes.
2.Agreeing to These Terms
You must be at least 18 years old to use our Services. By creating an account, submitting an application, making a payment, or otherwise using our website, you're agreeing to these Terms.
3.What Our Services Include
Through our website, you may be able to:
- Browse available rental properties
- Submit a rental application
- Pay rent or fees online
- Submit and track maintenance requests
- Access lease documents and account information
These Terms cover your use of the website. Your actual lease, or the management agreement you have with us if you're a property owner, is a separate signed document. If anything in these Terms conflicts with your lease or management agreement, the signed agreement wins.
4.Your Account
- Keep your login information private — you're responsible for what happens on your account.
- Give us accurate information, and update it if it changes.
- We may suspend or close accounts that are used fraudulently or that violate these Terms.
5.Payments
- Rent, deposits, application fees, and other charges are set out in your lease or agreement, not in these Terms.
- We may use a third-party payment processor to handle online payments. Using that processor means you also agree to its terms.
- We aren't responsible for delays or errors caused by your bank or a payment processor.
- Late fees may apply as described in your lease.
6.Property Listings
We do our best to keep listings, photos, and pricing accurate and current, but availability can change quickly. A property isn't officially reserved for you until a lease is signed and any required deposit is paid.
7.Rules for Using the Site
Please don't:
- Use the site for anything illegal
- Give us false or misleading information (including on a rental application)
- Try to hack, disrupt, or scrape the site
- Harass or threaten other users, our staff, or vendors
We may remove content or restrict access for anyone who breaks these rules.
8.Maintenance Requests
Submitting a maintenance request through the site doesn't guarantee a specific repair time unless your lease says otherwise. For emergencies call 911
9.Fair Housing
H&H Management Inc. is committed to complying with the Fair Housing Act and Arizona fair housing law. We do not discriminate based on race, color, national origin, religion, sex, familial status, or disability. We provide reasonable accommodations for service and emotional support animals as required by law.
10.Arizona Law
Because our properties are located in Arizona, the following state rules apply to residential leases we manage, in addition to the specific terms in your lease:
- Arizona residential leases are governed by the Arizona Residential Landlord and Tenant Act (A.R.S. §§ 33-1301 to 33-1381).
- Security deposits (including any prepaid rent counted toward it) cannot exceed one and one-half months' rent. Any nonrefundable fees must be clearly labeled as nonrefundable in the lease. After your tenancy ends, we have 14 days (excluding weekends and legal holidays) after you vacate and request your deposit back to send you an itemized list of any deductions along with any amount owed to you.
- Except in an emergency, Arizona law requires at least two days' notice before a landlord or property manager enters an occupied unit, and entry must occur at reasonable times.
- For month-to-month tenancies, Arizona law requires at least 30 days' written notice before a rent increase takes effect. For a fixed-term lease, rent cannot change mid-lease unless the lease specifically allows it. Arizona law preempts local rent control, so no city or county in Arizona can cap the rent a private landlord charges.
- Either party generally must give at least 30 days' written notice before the next rent due date to end a month-to-month tenancy.
- For most lease violations, Arizona law allows a 10-day notice to correct the issue before further action can be taken; certain serious violations (such as illegal drug activity or acts that threaten health or safety) may allow for a faster process.
- Property management activities such as listing, leasing, and collecting rent on behalf of property owners in Arizona generally require an active real estate broker's license through the Arizona Department of Real Estate (ADRE). H&H Management Inc. operates under a licensed designated broker as required by Arizona law.
11.Third-Party Links and Tools
Our site may link to or use third-party tools (like payment processors or screening providers). We don't control those third parties and aren't responsible for their content or practices. Anything you do through a third-party tool is subject to that provider's own terms.
12.Ownership of Site Content
Everything on this website — text, graphics, logos, photos — belongs to H&H Management Inc. or our licensors. You're welcome to use it for your own personal purposes (like viewing your lease), but please don't copy, republish, or reuse it commercially without our written permission.
13.No Guarantees
We provide this website "as is." We don't guarantee it will always be available, error-free, or secure. Nothing here limits any rights or protections you have under the Arizona Residential Landlord and Tenant Act, the Fair Housing Act, or other laws that can't be waived by agreement.
14.Limits on Our Liability
To the extent allowed by law, H&H Management Inc. and our employees and agents aren't liable for indirect, incidental, or consequential damages related to your use of this website. Our total liability for any website-related claim won't exceed the amount you paid us, if any, in the past 12 months. This limit doesn't apply where the law doesn't allow it — for example, in cases of gross negligence or willful misconduct.
15.You Agree to Cover Us
If your misuse of the website or violation of these Terms causes a claim against us, you agree to cover our reasonable costs and legal fees related to that claim.
16.Ending Access
We may suspend or end your access to the website if you violate these Terms. This doesn't affect your separate lease or management agreement, which continues under its own terms.
17.Changes to These Terms
We may update these Terms from time to time. We'll post the updated version online and change the "Last Updated" date. Continuing to use the site after changes means you accept the update.
18.Governing Law
These Terms are governed by Arizona law. Any dispute will be handled in the state or federal courts located in Maricopa County, Arizona.
19.If a Section Doesn't Hold Up
If any part of these Terms is found unenforceable, the rest still applies.
